PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING DOCUMENT THAT AFFECTS YOUR RIGHTS. BY SIGNING BELOW, YOU AGREE TO ALL THE TERMS AND CONDITIONS SET FORTH HEREIN. ASSUMPTION OF RISK. I acknowledge that participation in jiu jitsu training, martial arts classes, competitions, seminars, and all related activities (collectively, “Activities”) involves inherent and significant risks, including but not limited to physical injury, permanent disability, and death. I understand that these risks may arise from my own actions, inactions, or negligence, or those of others, including the Released Parties (as defined below). I voluntarily and knowingly assume all risks associated with the Activities, including any risk of death. RELEASE OF LIABILITY AND WAIVER OF CLAIMS. In consideration for being permitted to participate in the Activities provided by Adamson Bros Jiu Jitsu (“Academy”), I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby irrevocably and unconditionally release, waive, discharge, and covenant not to sue Adamson Bros Jiu Jitsu, its owners, officers, instructors, agents, employees, volunteers, and affiliated entities (collectively, the “Released Parties”) from any and all claims, liabilities, demands, actions, or causes of action whatsoever arising out of or related to my participation in the Activities. This release includes, without limitation, any claims based on the negligence of the Released Parties and extends to claims for wrongful death, personal injury, property damage, or any other loss or damage—even if such loss, damage, or injury is caused in whole or in part by the acts, omissions, or negligence of the Released Parties. INDEMNIFICATION. I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or in connection with my participation in the Activities, whether such claims are brought by third parties or arise from any legal theory, including claims in the event of my death. MEDICAL TREATMENT. In the event of injury or illness during my participation in the Activities, I hereby consent to receive any necessary medical treatment as determined appropriate by the Academy or by qualified medical personnel. I acknowledge that I am solely responsible for all costs and expenses incurred as a result of such treatment. I further release the Released Parties from any claims arising out of or in connection with any medical treatment provided. REPRESENTATIONS AND WARRANTIES. I represent and warrant that I am physically and mentally capable of participating in the Activities and that I have consulted with a physician regarding my ability to engage in such strenuous physical activity if necessary. I affirm that I have no medical or other conditions which would interfere with my safe participation in the Activities, and I agree to comply with all safety rules, instructions, and guidelines provided by the Academy. BINDING EFFECT; SURVIVAL OF RELEASE. This Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Oregon. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. I agree that the terms of this Agreement shall survive and apply even in the event of my death, and that my heirs, legal representatives, or assigns shall be bound by the terms hereof and waive any claims against the Released Parties. GOVERNING LAW AND JURISDICTION. This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of laws principles. Any disputes arising from or related to this Agreement shall be resolved exclusively in the appropriate state or federal courts located in Oregon, and I hereby consent to the personal jurisdiction and venue of such courts. ACKNOWLEDGMENT OF UNDERSTANDING. I have read this Agreement in its entirety and fully understand its terms. I acknowledge that by signing this Agreement I am voluntarily giving up substantial legal rights, including the right to pursue any claims against the Released Parties for any injuries or damages sustained, including in the event of death. I affirm that I am signing this Agreement freely and voluntarily, and that no oral representations or inducements apart from the foregoing written agreement have been made to me.
